The fianc\u00e9e of Michael Virgil alleges crew members over-served him alcohol, violently restrained him, and contributed to his death; the L.A. County Medical Examiner ruled it a homicide.<\/em><\/h2>\n\n\n\n

Royal Caribbean is facing a wrongful-death lawsuit<\/strong> filed by the fianc\u00e9e of Michael Virgil, 35<\/strong>, who died aboard the Navigator of the Seas<\/em> in December 2024.<\/p>\n\n\n\n

The lawsuit, filed by Connie Aguilar<\/strong> in federal court in Miami, accuses the cruise line of gross negligence<\/strong>, alleging that crew members served Virgil at least 33 alcoholic beverages<\/strong>, then violently subdued him in a prone restraint that restricted his breathing and led to his death.<\/p>\n\n\n\n

Royal Caribbean has not commented on the lawsuit.<\/p>\n\n\n\n

ALLEGED OVER-SERVING, INTOXICATION & ESCALATION<\/h2>\n\n\n\n

Aguilar, her fianc\u00e9, and their child were on a round-trip cruise from Los Angeles to Ensenada, Mexico<\/strong>, when the incident occurred. According to the complaint, crew members continued to serve Virgil alcohol even though he showed \u201cvisible signs of obvious intoxication.\u201d<\/strong><\/p>\n\n\n\n

The lawsuit states that after consuming more than two dozen drinks, Virgil became disoriented and agitated while attempting to locate his cabin.<\/p>\n\n\n\n

Video obtained by KTTV shows Virgil kicking a cabin door and shouting profanities.
A passenger told the station that Virgil threatened him and a crew member, prompting the crew member to lock himself inside a towel room.<\/p>\n\n\n\n

Moments later, security guards restrained Virgil.<\/p>\n\n\n\n

The lawsuit claims that crew members:<\/p>\n\n\n\n

  • Tackled Virgil<\/strong> to the ground<\/li>\n\n\n\n
  • Placed their full body weight<\/strong> on his back and torso<\/li>\n\n\n\n
  • Held him in a prolonged prone restraint<\/strong><\/li>\n\n\n\n
  • Compromised his breathing<\/strong><\/li>\n\n\n\n
  • Administered a sedative<\/strong> at the captain\u2019s direction<\/li>\n\n\n\n
  • Used pepper spray<\/strong> on him<\/li>\n<\/ul>\n\n\n\n

    Aguilar alleges this combination caused:<\/p>\n\n\n\n

    • Cardiac arrest<\/strong><\/li>\n\n\n\n

        ALLEGATIONS OF INADEQUATE TRAINING & MEDICAL CARE<\/h2>\n\n\n\n

        The lawsuit further claims that:<\/p>\n\n\n\n

        • Onboard medical staff lacked proper education, licensing, and emergency-care experience<\/strong><\/li>\n\n\n\n
        • Crew members were not properly trained<\/strong> to determine when alcohol service should have been stopped<\/li>\n\n\n\n
        • Staff used excessive force and failed to follow recognized safety protocols for handling intoxicated passengers<\/li>\n<\/ul>\n\n\n\n

          Aguilar is seeking unspecified damages<\/strong> and a jury trial<\/strong>.<\/p>\n\n\n\n
